These Terms of Use govern access to and use of the Wyzefy platform (the "Platform"), which lets you create and manage online stores for digital products. By creating an account or using the Platform, you (the "Merchant") confirm that you have read and agree to these terms.
1. The Platform
Wyzefy provides software tools for the Merchant to build their store, list products, accept payments through payment providers of their choice, and deliver digital products to their customers. Wyzefy is not the seller of the products listed in the stores and is not a party to the consumer relationship between the Merchant and their customers.
2. Account and registration
- The Merchant must provide accurate information and keep it up to date.
- The Merchant is responsible for keeping their password and two-factor codes confidential, and for all activity carried out on their account and by their team members.
- Wyzefy may refuse, suspend or terminate accounts that breach these terms or applicable law.
3. Payments
Store payments are processed by third-party payment providers using the Merchant's own credentials. Funds are received directly into the Merchant's account with those providers, which apply their own fees and conditions. Wyzefy does not hold or take custody of sales proceeds.
4. Merchant responsibilities
- Sell only lawful products and services that the Merchant has the right to sell.
- Comply with consumer-protection law, data-protection law (such as Brazil's LGPD) and the tax obligations that apply to their business.
- Publish clear information in their store about products, prices, delivery times, exchanges and refunds, along with their own terms and privacy policy.
- Support their customers and handle complaints, chargebacks and refund requests.
5. Prohibited uses
You may not use the Platform to: sell illegal, counterfeit, stolen or fraudulently obtained products; carry out phishing, scams or any form of fraud; distribute malware; infringe intellectual-property rights; send spam; or attempt to access other stores' data or bypass the Platform's security mechanisms.
6. Content and intellectual property
The Merchant retains ownership of the content they publish (text, images, templates and products) and grants Wyzefy the license needed to host and display it while the account is active. Wyzefy's brand, software and dashboard belong to Wyzefy.
7. Availability
Wyzefy makes reasonable efforts to keep the Platform available and secure but does not guarantee uninterrupted operation. Maintenance may take place, preferably during off-peak hours.
8. Limitation of liability
To the maximum extent permitted by law, Wyzefy is not liable for lost profits, indirect losses, failures of third-party providers (payment, hosting, email, DNS) or for the acts of the Merchant and their customers.
9. Termination
The Merchant may close their account at any time. Wyzefy may terminate or suspend accounts in the event of a breach of these terms, with prior notice where possible.
10. Changes and governing law
These terms may be updated, and the current version will always be available on this page. These terms are governed by the laws of Brazil; the courts of the consumer's domicile (where applicable), or otherwise the courts of Wyzefy's registered office, shall have jurisdiction.
